Expanding Employer Sponsored Pathways to Permanent Residence (PR)

The Department of Home Affairs has expanded access to permanent pathways for subclass 482 Temporary Skill Shortage (TSS) holders and 457 skilled workers in all streams (that is Short-term, Medium-term and Labour Agreement streams), to now apply for the following permanent visa’s:

  • Subclass 186 Employer Nomination Scheme (ENS) – Temporary Residence Transition (TRT) stream
  • Subclass 187 Regional Sponsored Migration Scheme (RSMS) – Temporary Residence Transition (TRT) stream

The length of time required to hold a subclass 482 or 457, has now been reduced to a minimum of at least 2 years (not including any periods of unpaid leave) in the period of 3 years immediately before the subclass 186/187application is made.

You should be eligible if:

  • You have worked in a position with your sponsoring employer for 2 out of 3 of the previous years, while holding a subclass 482 or 457;
  • You have been employed full-time in Australia while holding your subclass 482 or 457;
  • Your employer wishes to offer ongoing employment

These changes have replaced the temporary concessions that the Department introduced during COVID-19 pandemic to allow for temporary visa holders to transition to a permanent visa and now has immediate effect. These changes will allow equitable access to permanent residence for temporary skilled workers.

We anticipate pending further reforms arising from the review of Australia’s migration program.
